This concerns private and professional life. Notarial deeds have a high legal and authentic value. The notary plays a central role in the legal security of transactions and the protection of the interests of all parties.

 1. Authentication and legal certainty

The notary is a public officer who gives an authentic value to the deeds he or she drafts (real estate sale, inheritance, donation, etc.). A notarial deed has a higher probative value than a private deed and is authentic until a forgery is registered. The signature before a notary guarantees the certain date, legal compliance and enforceability against third parties.

2. Legal obligations

Many deeds must be executed before a notary in Luxembourg:

Purchase or sale of real estate: all real estate transactions must be drawn up by notarial deed.

Company incorporation: the creation of a SARL, SA, SCA, SCSp or other companies requires a notarial deed for the establishment of the articles of association.

Donation and inheritance: the organisation of the transfer of assets requires the intervention of the notary to guarantee the legality and validity of the provisions. Marriage or partnership contracts: these agreements must be drawn up by a notary to be fully valid.

3. Impartial and personal advice

The notary has a duty to advise all parties. It provides information on the legal, tax and patrimonial consequences of operations. He ensures the balance of interests and the prevention of disputes.

4. Securing funds and securing payments

The notary ensures the secure management of the funds related to the transaction (e.g. escrow during a real estate purchase). He ensures the regularization of payments and the proper transmission of deeds.

5. International recognition

Luxembourg notarial deeds are recognised in the European Union and enjoy strong international legal certainty.
